Virginia Rules & Audits

The Compliance Roadmap for 2026

Navigating Virginia’s new legal requirements shouldn't be a guessing game. Below is the definitive breakdown of the 2026 mandates and the internal audit checklists your organization must maintain to meet the PPE Standard.

The 2026 Compliance Checklists:

Checklist 1: Mandatory Reporting (SB 556)
Under the new law, the definition of "Mandated Reporter" has expanded significantly.

  • [ ] Broadened Scope: Are all athletic coaches, directors, and adult volunteers (public and private) officially designated as Mandated Reporters in your staff handbook?

  • [ ] Expanded Offenses: Has your staff been trained to report not just "abuse," but specific obscenity and indecent liberty offenses?

  • [ ] The 24-Hour Rule: Does your organization have a written protocol ensuring every report is made to the local department or state hotline within 24 hours of suspicion?

  • [ ] Penalty Awareness: Is your leadership aware that failure to report now carries a $500 fine for a first offense and $1,000+ for subsequent failures?

Checklist 2: Institutional Access (HB 1490)
The state is centralizing its response, requiring faster and more direct access during investigations.

  • [ ] Designated Liaison: Have you appointed a Primary Safeguarding Liaison to act as the central point of contact for the VDSS Centralized Hotline?

  • [ ] The Under-3 Protocol: Do you have a policy in place to allow CPS investigators immediate face-to-face access to children under the age of three (required within 24 hours of a valid report)?

  • [ ] Interview Recording: Are your staff prepared for the new standard (HB 1222) which permits the recording of interviews between CPS personnel and those involved in a family assessment?

Checklist 3: Training Logistics (HB 1626)
The most significant administrative change involves how much time your staff can spend in non-academic training.

  • [ ] The 25-Hour Cap: Do you have a system tracking every staff member's training hours to ensure they do not exceed the 25-hour cap over five years?

  • [ ] The Attestation Log: Do you have signed, time-stamped attestations for every teacher and coach proving they understand the subject matter?

  • [ ] Frequency Audit: Are you ensuring "non-academic" training occurs no more than once every six months for new hires and once every five years for veterans?

Managed Audits: The "Audit-Ready" Guarantee
The burden of proof rests on the institution. If an incident occurs, "we didn't know" is not a defense. PPE Kids provides Third-Party Oversight to ensure your audit trails are airtight.
